The Salem Township Board of Trustees met March 18, 2008 in a special session at the Township Hall for the purpose of holding a public hearing for a zoning issue. Chairman Dick Kilburn called the meeting to order at 7:00 P.M. with members Kirk Ramsey and Dick Dare present.

Others present were Fred Lafollette, Ralph Blanton, Donald Lynch, Mr. & Mrs. David Opperman, Mark Davis, Lee Short and Pete Christiansen.

Zoning Code Change
Mr. Kilburn asked the zoning commission to present the proposed changes. Mark Davis opened the discussion by stating the proposed changes had been sent to the Warren County RPC as required and were approved in their entirety as stated in a letter from the WCRPC dated January 28, 2008.

The three (3) changes are as follows:
Resolution 01-08 Temporary Uses, chapters 3 and 26
Resolution 02-08 Non-conforming Uses, chapter 19
Resolution 03-08 Existing Lots of Record

01-08 amends chapter 3 definitions by adding 3.441 Temporary Use. Revise number sequence of “Farmer, tenant” definition from 3.44 to 3.442. Amends chapter 25 by adding 26.08 – Temporary use language addressing specific temporary use situations.
02-08 amends chapter 19 by removing Section 19.04 in its entirety and replacing it with language permitting the rebuilding, replacement or continued use of a structure damaged accidentally or by an Act of God.
03-08 amends chapter 19 by adding language to Section 19.05 #3 permitting a portion of a lot to be added to a portion of an adjoining lot, provided that neither of the two become more nonconforming.

The changes mostly made the language more specific.

Dick Dare asked about the use of trailers at construction sites and questioned the part about having them behind the site. Mr. Davis explained that there was wording that in a hardship case it could be put in another space by the ruling of the zoning inspector.

It was then opened to the floor for comments and questions.
Donald Lynch had several questions and comments about each change. Mr. Davis explained to him that the resolutions actually gave back more rights to the residents and did not take anything away from them.
Mr. Lynch then read a prepared letter of disapproval of the proposed changes.

There were no other comments or questions from the floor.

At this time Dick Dare made a motion to pass Resolution 08-0318 whereby the Salem Township Board of Trustees approves the three zoning resolutions that make changes to the Salem Township Zoning Code as written by the Salem Township Zoning Commission. Kirk Ramsey seconded the motion.

With no further business to come before the board, Dick Dare made a motion to adjourn the meeting at
7:25 P.M. Kirk Ramsey seconded the motion.
