The Salem Township Board of Trustees met May 27, 2008 in regular session at the Township Hall for the purpose of transacting the business of the Township. Chairman Dick Kilburn called the meeting to order at 7:00 P.M. with members Kirk Ramsey and Dick Dare present.

Others present were Fred Lafollette, Bill Harrison, Mike Kassalen, Ralph Blanton, Donald Lynch, Mr. & Mrs. David Opperman, Bob Glancy, John Schuler, and Ed McCall.

The minutes were read and posted in the township hall.

ZONING
Donald Lynch Complaint
Mr. Lynch brought before the board a mandamus action that stated all zoning codes must be applied equally to all residents. He asked the trustees to initial a copy, but they refused to do so without having approval from the county prosecutor. He again requested information on the assistant zoning inspector’s status, but the fiscal officer had already sent him allowable information.

Schuler Zoning issue
John Schuler wanted to address the complaints that had been issued regarding the animals running loose on his property. He told the board he had gotten rid of all the chickens but one and only had one pig left also. He plans on butchering that animal as soon as possible. He has also gotten rid of the junk cars and other trash. The board told him they appreciated his quick action in this matter.

Mike Kassalen brought up the complaint that Mr. Lynch issued last month about the dirt being moved near the former Papa’s Restaurant. He said he had driven by several times and did not see anything suspicious.

Roads/Crew
Fred LaFollette had the bids from the county resurfacing project. Our portion came in less than we had expected at $76,587.00. Dick Dare made a motion to approve the bid from the county and go forward with the project. Kirk Ramsey seconded the motion.

It was noted that Moore Sauer Road would be closed on Thursday for replacement of a culvert. The township crew will be doing the work.

They are continuing to work on the problem on Salem Road at the dip. He will meet Jason Fisher to look at that area.

Kirk Ramsey mentioned that he thought the cemetery looked really good on Monday.

Fire Department
Fred reported he had received a resignation from Jonah Holbrook. Dick Kilburn made a motion to accept this resignation. Kirk Ramsey seconded the motion.

Architect Contracts
Ed McCall was present to update the board on the status of the contract. He told them he had been in touch with Bruce McGary to answer any of the questions he had. Mr. McGary was questioning the amount of professional liability insurance for the job. If it was increased to the amount Mr. McGary had in mind, it would increase the cost by $2900.00 per year. Mr. McCall stated that they currently carry as much as any of the large Ohio firms. They have never had an occurrence in 25 years other than a claim for a drainage problem. The insurance is for errors and omissions coverage. At Mr. McGary’s request, Fred called the township’s insurance company to see what they had to say about the amount of coverage. He was told that without investigating MSA’s insurance company, he couldn’t say whether it was good enough so could not make a recommendation either way. It was noted that in the interviews, this was the same amount of insurance that all the bidders carried.
Retainage on the project was discussed. The amounts are 8% of the first half of the job, and then by the end of the job the retainage amount would be 4%. Dick Dare asked how long that is held. Mr. McCall stated it would be held until the final punch list is approved.
He also told the board he has been in touch with two good contractors to see what is happening in costs.

Miscellaneous

Ralph Blanton mentioned that there has been talk about the future use of the township meeting room in the new building. He said he has told people there would not be a rental fee, but they would be charged a small fee for utility use.

Dick Dare brought up the matter of the township mowing along the roads on Blackhawk. He stated he had thought about it and was concerned about liability since they were not township roads. Therefore, he stated he was against the township mowing there.

Fiscal Business

Transfer
The Fiscal Officer requested the board approve the transfer of $43,915.00 from the Fire Fund to the Debt Service Fund for the purpose of paying the interest and principal that is due on the Fire Truck Acquisition Note. Dick Kilburn made a motion to pass Resolution 08-0527 to approve the transfer of monies in the amount of $43,915.00 from the Fire Fund to the Debt Service Fund so that the interest and principal that is due on the Fire Truck Acquisition note can be paid. Kirk Ramsey seconded the motion. Vote: Kilburn, yea Ramsey, yea Dare, yea

Appropriation Modification
Debbie next brought before the board the following modifications to the appropriations:
Increase 14A05 Supplies $15,000
Decrease 14A01 Salaries $10,000
Decrease 14A02 Retirement $ 5,000

Kirk Ramsey made a motion to approve the appropriation modifications as requested. Dick Kilburn seconded the motion.

Approval to pay bills
The fiscal officer presented checks # 6443 through #6504, 98015 which totaled $127,098.89
The board examined the bills that were presented for payment and Dick Dare made a motion to pay the bills as presented. Dick Kilburn seconded the motion.

Receipts
For this reporting period the fiscal officer deposited receipts in the amount of $82,515.08. This amount included receipts #6070 through #6094.

With no further business to come before the board, Dick Dare made a motion to adjourn the meeting at
7:40P.M. Dick Kilburn seconded the motion.
